DPDP Specific Definitions
Definition: Who is a Significant Data Fiduciary (SDF)?
Under the DPDP Act, a Significant Data Fiduciary is a high-risk or large-scale data-processing entity that the Central Government formally notifies as “Significant” based on specific criteria.
Statutory Basis for SDF Designation
The Central Government may classify any Data Fiduciary as “Significant” after considering factors such as:
- Volume and sensitivity of personal data processed
- Risk of harm to data principal
- Impact on sovereignty and integrity of India
- Impact on democracy, electoral processes, or public order
- Any other factor the Government considers relevant
Entities Likely to be Classified as SDFs
- Companies processing large volumes of personal data like banks, Telecom Operators, social media platforms, Health-tech aggregators, Hospitals, Clinics, Large e-commerce marketplaces, Ad-tech and behavioural profiling companies, Large SaaS platforms processing Indian user data
- Organizations handling sensitive data (health, biometrics, financial)
- Platforms using AI/ML for profiling or automated decision-making
- Entities with systemic impact on society (e.g., social media, fintech, ad-tech)
- Businesses conducting cross-border profiling of Indian users
